Terms and conditions
This is a translation for your convenience. The Dutch version of these terms applies.
1. Company details and applicability
ANB Shots, based in Zaandam, Chamber of Commerce (KvK) number 87898470, VAT number NL004503051B87, email anbshots.info@gmail.com, provides video productions and related content services.
These terms apply to business assignments when they have been declared applicable and provided to the client before or when the agreement is made. In writing also includes email and WhatsApp, provided the sender and the agreement concerned are sufficiently clear. In case of conflict, individually agreed written arrangements take precedence over these terms.
2. Quotation and agreement
The quotation or service sheet describes the production, number of files, formats, schedule, price, tax treatment, usage rights and any external costs. The assignment is agreed when both parties clearly accept the specific offer. Acceptance can be given by signature, email or WhatsApp. A no-obligation request through the website is not a booking.
The shoot date is definitively reserved after written acceptance and receipt of the deposit, unless it has been agreed in writing that the deposit will be paid on the shoot day before the shoot starts.
3. Performance and cooperation
The parties agree in advance on the goal, the creative direction, the locations and the participants and materials needed. The client provides the agreed briefing, access, products and availability of participants in good time.
The parties record who is responsible for location permits, the consent of recognisable people and the rights to supplied material. ANB Shots ensures appropriate rights to music and stock it adds itself, within the agreed use.
ANB Shots delivers the agreed work and files. Reach, followers, revenue and other marketing results are not guaranteed.
4. Price and payment
The agreed price and the tax treatment stated in the quotation apply. For one-off productions, 50% is paid in advance. The remaining amount is paid before the final files are released.
Invoices are paid within 14 calendar days of sending. If the shoot takes place earlier, an earlier payment date agreed in advance is stated for the deposit. Payment on the shoot day is only possible by written agreement and before the shoot starts.
Monthly productions are invoiced and paid in advance per production month. The exact due date is on the invoice.
The first 25 kilometres per one-way trip from the business address in Zaandam are included. For kilometres beyond that distance, €0.35 per kilometre is charged for both the outward and the return trip. The calculation and any travel time fee are included in the quotation in advance. Parking is charged at actual cost when agreed in advance. Locations, models, crew and other external costs are specified and approved in advance. Costs that have not been agreed are not passed on automatically.
5. Delivery and feedback
The first version or versions are delivered within 7 to 14 calendar days after the shoot, unless a different schedule has been agreed in writing. For multiple videos, the parties agree in advance on the priority, delivery order and schedule of the other videos.
One bundled revision round within the approved concept is included per production, unless agreed otherwise. The client provides all feedback within 7 calendar days of receiving the first versions concerned, through one contact person.
The agreed revisions are delivered within 7 calendar days of receiving complete, bundled feedback. If feedback is late or incomplete, delivery moves to an available moment in the schedule; ANB Shots confirms the adjusted schedule. No response does not automatically count as approval.
Correcting a deviation from the agreed assignment by ANB Shots is not paid extra work and does not use up the included revision round.
6. Extra work
Extra footage, new concepts, additional versions and extra revision rounds beyond the agreed assignment are extra work. ANB Shots states the price and the effect on the schedule in advance. The work is carried out after the client's written approval.
7. Cancellation of one-off assignments
The client can cancel in writing. If cancelled more than 14 calendar days before the agreed shoot date, only preparatory work already carried out and pre-approved, non-recoverable external costs are charged.
If cancelled 14 calendar days or less before the agreed shoot date, a cancellation fee of 15% of the total agreed production price applies, plus pre-approved, non-recoverable external costs. Preparation is included in the 15% and is not charged again. The same costs are not charged twice.
The fee remains reasonable and justifiable, taking into account savings and applicable mandatory law. Payments received are set off against the itemised final invoice. Any surplus is refunded within 14 calendar days.
If ANB Shots cancels definitively, the deposit is refunded within 14 calendar days, without prejudice to the client's statutory rights.
This cancellation arrangement applies to one-off assignments. Article 9 applies to monthly programmes.
8. Rescheduling and inability to attend
The client can reschedule a shoot once free of charge when this is reported in writing at least 48 hours before it starts. A new date is set in consultation and based on availability. The deposit carries over. Pre-approved, non-recoverable external costs remain payable by the client, without double counting.
For a request within 48 hours, the parties discuss demonstrable extra costs and the effect on reserved capacity. If the assignment is cancelled, article 7 applies. Rescheduling does not automatically lead to a cancellation fee; any additional costs are agreed in writing.
ANB Shots also reports a foreseen rescheduling at least 48 hours in advance. In case of sudden illness, an accident or another unforeseen inability, the parties inform each other as soon as possible. In case of force majeure, a new date is agreed in consultation without a rescheduling fee; any external costs are discussed separately. For weather-dependent shoots, the parties agree in advance when conditions make the shoot impossible or unsafe.
9. Monthly collaboration
Monthly Content Partner is a fixed programme of three production months at the agreed programme price, which may be split into monthly payments. The programme then ends without automatic renewal. Continuing requires written agreement.
A pause of at most one month is possible after prior written consultation. The production, invoicing and end date concerned move along, so that the three production months are still carried out. Work already paid for but not yet carried out remains as credit. A shoot cancelled by ANB Shots is made up.
In case of a longer postponement, the parties can end the programme by mutual agreement. Work done, content delivered, reasonable costs already incurred and advance payments are settled in an itemised way. This provision gives no general right to end the fixed programme unilaterally without further settlement. Statutory termination rights remain in force.
10. Copyright and use
Insofar as ANB Shots is the rights holder, the copyright remains with ANB Shots. After full payment, the client receives a non-exclusive, worldwide licence without an end date for organic use of the final files on its own websites and social media channels, within any stated restrictions arising from third-party rights.
Paid advertising use, including boosting posts, requires prior written permission. The surcharge is 20% of the original, separately specified filming or shooting costs for the content concerned. Editing costs, travel costs and other external costs fall outside this basis of calculation. For a monthly programme, only the content or production month concerned is included. The files and the use to which the permission applies are recorded in writing.
Any additional licence costs beyond the coverage of the music or stock licences used are only passed on after prior approval. There is no automatic extra music surcharge when the agreed use is already covered, for example by a suitable Artlist Pro licence.
Transfer to third parties, resale, exclusivity, television use and further editing are agreed separately. Music and stock are not transferred as separate assets and remain subject to their own licence terms.
11. Portfolio and own promotion
Permission for use by ANB Shots on its own website and channels is recorded in writing in advance. Use in principle takes place after the client's first publication, unless agreed otherwise. Without recorded permission, ANB Shots asks for separate approval. The client's permission does not replace any required consent of recognisable people shown or other rights holders.
12. Files and retention periods
Raw footage and project files are not delivered as standard. Different arrangements about delivery and price are recorded in writing.
Raw footage and project files are kept for three months after final delivery and may be deleted after that. Additional edits within this period are quoted separately. Longer storage is only included when agreed in writing in advance.
The final products are available through a download link for one year from final delivery. The client downloads the files within this period and makes its own copy and backup. After this period, ANB Shots may end the online availability.
13. Confidentiality and personal data
The parties treat non-public business information as confidential. Personal data is processed for the agreed purposes. The separate privacy statement describes how ANB Shots processes personal data. If a data processing agreement is needed for an assignment, it is concluded separately.
14. Defects and liability
The client reports a defect it finds as soon as possible, with a clear description. For a repairable defect, ANB Shots is given a reasonable opportunity to repair it.
Each party is liable for damage that can be attributed to it by law. These terms contain no separate fixed limitation of liability. Any additional arrangement about this is expressly recorded in writing and must suit the assignment and the applicable statutory rules.
15. Additional arrangements and disputes
Changes and additional arrangements apply after written approval by both parties. The parties first try to resolve a dispute through consultation. Dutch law applies to the agreement. Disputes are submitted to the court that has jurisdiction by law.
